The Empty Chest Haunted Adventure WAIVER
RELEASE OF LIABILITY, WAIVER OF CLAIMS AND ASSUMPTION OF RISKS AGREEMENT (hereinafter referred to as the
"Release Agreement")
BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM
COMPENSATION FOLLOWING AN ACCIDENT. PLEASE READ CAREFULLY!
The Empty Chest Society and its directors, officers, employees, agents, representatives, independent contractors,
subcontractors, suppliers, hosts, volunteers, successors and assigns (all of whom are hereinafter referred as the
“Releasees”).
Express Assumption of Risk Associated with Recreational Activities
I hereby affirm and acknowledge that I have been fully informed of the inherent hazards and risks associated with participating in the empty
Chest Haunted Adventure. Inherent hazards and risks include but are not limited to:
1. The risk of injury and/or death from the activities involved at the The Empty Chest includes, but is not limited to the following: collision with persons or objects equipment related hazards, and accidents
involving, but not limited to, running falling, jumping, climbing, contact with objects, contact with other patrons, and/or contact with
the Releasees.
2. I further understand and acknowledge that any of these risks and others, not specifically named, may cause injury or injuries that may
be categorised as minor, serious, or catastrophic. Minor injuries include, but are not limited to: scrapes, bruises, sprains, animal bites
and/or stings, nausea, dizziness and cuts. Serious injuries include, but are not limited to: property loss or damage, broken bones,
fractures torn or strained ligaments and tendons, concussions, exposure, dehydration, heat exhaustion and other heat-related illnesses,
mental stress or exhaustion, infection, vomiting, dislocations, hyperthermia, hypothermia, anemia, electrolyte imbalance, loss of
consciousness, syncope, fainting, seizures, electric shock and/or injury, and neurological disorders/pain. Catastrophic injuries are rare.
These injuries can include but are not limited to, permanent disabilities, stroke, single or multiple organ failure or dysfunction,
physical damage to organs, spinal injuries, paralysis, heart attack, heart failure, blood cell disorder, brain swelling, and even death.
3. I understand that the Empty Chest Haunted Adventure is physically and mentally intense. I understand the rules of participation and
will comply with all rules and regulations. I will also follow all instructions given to me by the Releasees. I do hereby assume all
responsibility for my participation.
4. AFTER THE OPPORTUNITY TO FULLY INFORM MYSELF ABOUT THE EVENT, I KNOWINGLY AND FREELY ASSUME
AND ACCEPT ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, even if arising from the negligence of the Releasees,
and assume full responsibility and all risks for my participation in the The Empty Chest.
Release of Liability, Waiver of Claims and Indemnity Agreement
In consideration for being permitted to participate in the activity(ies) described above the related activities
1. I HEREBY RELEASE AND HOLD HARMLESS WITH RESPECT TO ANY AND ALL INJRUY, DISABILITY, DEATH, or loss or
damage to person or property, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE, the Releasees.
2. To release the Releasees, from liability and responsibility whatsoever and for any claims or causes of action that I, my estate, heirs, survivors,
executors, or assigns may have for personal injury, property damage, or wrongful death arising from the above activities whether caused by active
or passive negligence of the releases. By executing this document, I agree to hold the Releasees harmless and indemnify there in conjunction with
any injury, disability, death, or loss or damage to person or property that may occur as a result of engaging in the above activities.
3. By entering into this Agreement, I am not relying on any oral or written representation or statements made by the Releasees, other than what is
set forth in this Agreement.
This release shall be binding to the fullest extent permitted by law. If any provision of this release is found to be unenforceable, the remaining
terms shall be enforced.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, AND I FULLY UNDERSTAND ITS
TERMS, AND UNDERSTAND THAT I HAVE GIVEN UP LEGAL RIGHTS BY SIGNING IT, AND I SIGN IT FREELY AND
VOLUNTARILY WITHOUT ANY INDUCEMENT.

Entry and Participation Agreements Rules: I agree to become familiar with and abide by all written and/or posted
rules of The Empty Chest Haunted Adventure, as well as all written and/or posted rules of the Venue. I further
agree to comply with all directions, instructions and decisions of The Empty Chest personnel. I further agree not to
challenge these rules, directions, instructions, or decisions on any basis at any time.
Emergency Delay or Cancellation: I acknowledge that The Empty Chest Personnel at their sole discretion may
delay, modify, or close the Haunted Adventure if conditions or natural or man-made emergencies make operation
unreasonably difficult or unsafe. In the event of a delay, modification, or cancellation of the Haunted Adventure, I
understand that I will not be entitled to a refund of my entry fee or any other costs incurred.
Govern Participation: I understand that The Empty Chest Personnel have the authority to issue instructions or
directions relating to the manner of my safe participation in the Haunted Adventure.
Removal from the Haunted Adventure: I understand that The Empty Chest Personnel may immediately cause
anyone who disobeys any rules, directions, instructions, decisions, or laws, or whose behaviour endangers safety or
negatively affects a person, facility, or property of any type or kind, to be removed from the Haunted Adventure.
Fee Refunds: I understand that all fees and associated costs, paid in registration are not refundable for any reason
under any circumstances, including but not limited to injury, a scheduling conflict, and/or a cancellation.
Attitude and Behaviour: I also agree to exhibit appropriate behaviour at all times; demonstrate respect for all
people, equipment, and facilities; and participate with a cooperative and positive attitude.
Alcohol & Drugs: I certify that I am not, and on the date of my participation in the Haunted Adventure will not be,
under the influence of alcohol or any non-prescription drugs that would in any way impair my ability to safely
participate. I further understand that the consumption of any alcohol and any illicit or illegal drugs or substances at
the Haunted Adventure is strictly prohibited unless otherwise advised by The Empty Chest Personnel.
Specific Rules: I specifically acknowledge and agree to abide by the following rules: 1) no urination or defecation is
permitted outside of designated areas; 2) no wheeled conveyances or pets are allowed in the Course at any time;
3) no clothing, props or equipment that pose an unnecessary risk to participants, spectators or personnel are
permitted; and 4) obey civil and criminal laws including traffic laws.
Majority Age: I affirm that I have reached majority age. Majority age is 19 in British Columbia.
